"User", "you", or "your" means every natural or legal person, or representative of such person that uses the Offerings.
The Policy explains what information is gathered, how such information is used, under what circumstances this information is shared, and what rights the User has over said information. This policy applies if the User accesses the Offerings through a browser, mobile app, or by any other existent means or that may exist in the future. By the use of the website, platform or app of Cornershop, it is understood that the User has read and accepted this Policy.
If the User does not approve of the Policy, the User must NOT access or use the Offerings in any way, whether directly or indirectly, or access or use any type of information or service offered by the Offerings.
The Offerings are only available for use by persons who are 18 years of age or older. If User is not at least 18 years of age, the User must NOT access or use the Offerings in any way, whether directly or indirectly, or access or use any type of information or service offered by the Offerings.
THE USER EXPRESSLY DECLARES IT IS IN FULL KNOWLEDGE OF THE TERMS OF THIS POLICY AND ACCEPTS THIS POLICY AND THE RIGHTS THIS GRANTS HIM/HER.
Acceptance and Modifications. A User accepts this Policy immediately upon using, in any way, any of the Offerings and, upon acceptance, this Policy shall constitute a valid and binding agreement between the User and the Company.
We collect personal information which you voluntarily provide; for example, when you visit our website, use our app or Platform, create an account, or contact us. In particular, the Company must gather your telephone number for the purposes of the Offerings, and on behalf of the independent contractors who provide shopping ("Shoppers") and delivery ("Deliverers") services. As other examples, Cornershop may collect the names, dates of birth, addresses, emails, IP addresses, and internet use data, of Users.
If you register for an Offering through any social network account you explicitly consent to Cornershop accessing your personal information contained in that social network account.
The Company may, from time to time, use "cookies" solely for security and authentication purposes. Cookies are small pieces of data which are stored on your computer or smart device to allow your internet browser to remember something about a website and/or Offerings. At your option, you may turn off Company's "cookies" using the applicable features contained in your internet browser; however, doing so may prevent you from accessing all or part of the Company's Platform and/or Offerings. To readjust your internet browser's "cookies" options, refer to the applicable instruction documentation for your particular internet browser.
The Company may, from time to time, engage third parties to assist with the Offerings, and such third parties may track your usage, locate your geographic position, collect personal information, send messages to you on behalf of the Company, push notifications to you, and use "cookies", as discussed herein.
The Company may use web beacons or tags alone or in conjunction with "cookies" to compile information about you and your usage of the Offerings, as well as your interaction with emails from us. Web beacons are clear electronic images that can recognize certain types of information on your computer, such as "cookies", when you viewed a particular website tied to the web beacon, and a description of a website tied to the web beacon. For example, we may use web beacons to operate and improve the Offerings and email communications. We may use information from web beacons in combination with personal information about you to provide you with information about us and our Offerings.
When the Company receives personal information from you for the purposes of providing you with the Offerings or for other uses identified herein by the Company, you are providing the Company with consent as follows: (i) to allow the Company to deal with that personal information in a reasonable manner; (ii) to allow the Company to provide your personal information to third parties it engages to provide or support the Offerings, and to Shoppers and Deliverers; (iii) to allow the Company to use and store your personal information for the purpose of providing you with the Offerings; and (iv) to allow the Company to transfer your personal information outside of Canada (whereby your personal information will be treated in accordance with applicable foreign laws) for the purpose of storage and use of your personal information by the Company.
If you purchase alcohol, tobacco, or vapour products through any Offering or any activity of a Shopper or Deliverer, Cornershop or the Shopper or Deliverer may be required by law to share certain information with the retailer who makes the sale. This information could include at least the names and addresses of the purchaser and recipient, government issued ID information, the quantity, brand, price, proof and volume of such products purchased, and a recipient signature.
If you need to provide the Company with personal information about another individual, you represent and warrant to the Company that you have obtained the consent of that individual to the collection, use and disclosure by the Company for the specific purpose(s) that the disclosure is made by you before you provide the information to the Company.
There are legal exceptions whereby the Company will not need to obtain consent or explain the purposes for the collection, use or disclosure of personal information. Some examples of situations where consent is not required include an emergency that threatens the life, health or security of an individual, or if the Company must comply with a court order or governmental order.
The Company may offer information analysis or segmentation to third parties that provide or support the Offerings. Such third parties may, in turn, use the information gathered to predict the Users' characteristics, behavior or preferences. Both the information shared by the Users and the information directly gathered by the Company may be transferred to third parties, such as other internet websites, browsers or companies specializing in other fields, located anywhere in the world. The User explicitly accepts the use of such information in accordance as described in this paragraph.
Confidentiality and Information Security. The Company has taken commercially reasonable security measures to protect the information it collects from the Users, and kept to ensure that it is confidential. Access to personal information is restricted to those employees, contractors, representatives and agents of the Company who may need to know such information in order to perform their tasks and fulfill their roles in the development or improvement of the Offerings. We seek to restrict the access, modification or disclosure of this information by any person who is not authorized by either the Company or the User. The Company will require that its service providers respect and maintain its confidentiality standards in the treatment of the Users' information.
However, the Company cannot guarantee , and will not be held responsible in any way if there is any unauthorized third party breach of the Platform's security measures, even when it involves the misuse of personal information.
The Company may utilize third party external servers as well as other external services, including cloud services and cloud compatible servers. The Companydoes not have any control over such external servers or services.
Under Age Users. The Company does not knowingly collect personal information from visitors to our Platform who are under 18 years of age. In the event that we learn that we have collected personal information from a minor under 18 years of age without verification of parental consent, we will delete that information from our Platform.
Retention and Destruction of Personal Information. The amount of time the Company will retain personal information varies, depending on the Offerings provided and the nature of the personal information that the Company holds. The Company retains personal information for such period of time as is necessary for the Company to maintain sufficient information so the Company may respond to any issues that arise at a later date or as is required by law. When personal information is no longer required by the Company or by law, the Company will either convert it into an aggregated non-identifying form or will appropriately destroy or erase the personal information in a manner that is in accordance with its current policies and procedures.
Rights of Users Over the Information. For Users whose information has been collected, the Company shall provide Users with the means to access their personal information in order to edit, modify, update or delete such information, unless the User cannot do so due to a legal requirement or force majeure. In order to exercise these rights, the User must send a request to the Company, via email, and in turn, the Company might reject requests that are unreasonable, repetitive or systematic; that may require a disproportionate technical effort; that constitute a threat to the privacy of other Users; or that are considered impractical or contradictory to legal requirements and good practices. The access, modification, and/or deletion of information executed by the Company will be free of charge unless some payment must be made to a third party in order to access such information, in which case it will be the User's responsibility.
It is important to the Company that your personal information held by the Company is accurate and complete. Having accurate information about you enables the Company to give you better service. You can help the Company keep personal information up-to-date by keeping the Company informed of any changes, such as a change of address, telephone number or any other circumstances.
Withdrawal of Consent. You may, at any time, withdraw your consent to the Company's collection, use and disclosure of your personal information, subject to reasonable notice and any legal and/or contractual restrictions. Should you choose to withdraw your consent, the Company may be unable to provide, or continue to provide, of the Offerings that require personal information. Consequently, should you choose not to provide the Company with the required personal information, the Company may be unable to offer such Offerings to you.
